Appropriate Use Policy

This Appropriate Use Policy outlines the terms and conditions for using ScraperNinjas services, which can be found on our website at scraperninjas.com. As the applications for proxy servers are diverse, this policy serves as a guideline for our service offerings and is not an exhaustive list.

The following points detail violations of this Appropriate Use Policy. However, other unlisted acts or uses may also be considered violations in connection with the use of ScraperNinjas services:

1. Infringement of Property Rights: Members agree not to violate copyrighted, patented, or other intellectual property rights and proprietary material of third parties under any applicable laws. Using Bittorrent or similar P2P software with our service is strictly prohibited.
2. Email Spamming: Members agree not to engage in email spamming activities, including sending, re-sending, or transmitting bulk materials through ScraperNinjas services. This includes email, blog comments, social network messages, and forum spam.
3. Illegal Activities: Members agree not to engage in any illegal activities, such as death threats, terroristic threats, threats of harm, multi-level marketing schemes, Ponzi schemes, invasion of privacy, credit card fraud, racketeering, identity theft, defamation, slander, and other unlawful activities.
4. Child Pornography: Members agree not to view, promote, or engage in any activities related to child pornography or violate any laws related to such activities.
5. Threats and Harassments: Members agree not to threaten or harass any individual, organization, or business.
6. Fraudulent Activities: Members agree not to engage in any fraudulent activities.
7. Denial of Service Activities: Members agree not to engage in the origination or control of denial of service attacks, distributed denial of service attacks, or similar activities.
8. Malware Distribution: Members agree not to engage in the distribution, fabrication, or use of malware, including virus software, rootkits, password crackers, spyware, adware, keystroke capture programs, and other malicious programs.
9. Hacking Activities: Members agree not to attempt unauthorized access to any network or system, including computers, telephones, telefax, and other data storage systems.
10. Phishing Activities: Members agree not to engage in any phishing-related activities or systems designed to collect personal information, such as names, account numbers, usernames, passwords, and other identifying information.
11. Fraudulent Financial and Ponzi Schemes: Members agree not to engage in the promotion, offer, or sale of interests in illegal financial or Ponzi schemes.
12. Stalking Activities: Members agree not to engage in any form of stalking, whether targeting a person, organization, or otherwise.
13. Bullying Activities: Members agree not to engage in bullying any person, organization, or otherwise.
14. Defamatory Remarks or Conduct: Members agree not to engage in conduct or make remarks that are derogatory, demeaning, malicious, hateful, defamatory, or abusive.
15. Impersonation: Members agree not to impersonate any person, living or deceased, or assume the identity of any entity, whether legal or informal.
16. Violations Alleged by Third Parties: ScraperNinjas accepts third-party reports of alleged violations of this Appropriate Use Policy or other violations. We will review all reports and may take appropriate actions at our discretion, including notifying the member involved.
17. Simultaneous Connections: Members agree that ScraperNinjas can limit the number of simultaneous connections and connections per session to ensure stable service for all members. Corrective action may include disconnection or discontinuation of any and all services or termination of the agreement, which may be taken at ScraperNinjas' sole discretion. If ScraperNinjas takes any corrective action under this section, the member shall not be entitled to a refund of any fees paid in advance prior to such action.

18. Consequences of Breaching the Policy: Upon detecting a breach of this Appropriate Use Policy, ScraperNinjas may, at its sole discretion, immediately terminate the services provided to the member, without notice or refund, and potentially with abuse processing fees as outlined in the Terms of Service. The member acknowledges that ScraperNinjas' decision will be final and binding.
19. Violation of Laws: The member agrees not to engage in any activity that violates civil or criminal law, whether local, state, national, or international.
20. Access to Certain Websites: Members are informed and agree that they have no access to specific websites through ScraperNinjas services. Attempting to access such websites is prohibited. The full list can be requested via email from ScraperNinjas and represents Appendix A to the Terms of Service.
21. Use of Certain Software: Members are informed and agree that using certain software with ScraperNinjas services is prohibited. The full list of such software can be requested via email from ScraperNinjas and represents Appendix B to the Terms of Service.
22. Method of Resolution for Alleged Violations: Upon discovering an alleged violation of this Appropriate Use Policy, the member will be notified and given a designated time to respond. If the member fails to respond within the provided time, ScraperNinjas may, at its sole discretion, immediately terminate the services without notice or refund. If ScraperNinjas finds a violation after receiving the member's response, it may also terminate the services without notice or refund.
23. Security of Customer Information: Members understand and agree that ScraperNinjas cannot guarantee, assure, or promise that their information or data will not be compromised by unauthorized access. The member holds ScraperNinjas harmless in the event of any breach of security to their data or information.
24. Monitoring of Member's Use of Services: At its sole discretion, ScraperNinjas may monitor a member's use of its services to protect or enforce its rights under the Terms of Service, this Appropriate Use Policy, or the Website Information.
25. Disclosure Pursuant to Subpoena: ScraperNinjas may be required by law to provide a member's information pursuant to a subpoena issued by a court, government entity, or otherwise. Information shall be disclosed as directed, and ScraperNinjas will release the information described in the subpoena.
26. Data Collection and Retention: ScraperNinjas collects and maintains informational logs relating to members' use of its services, websites visited, and payment information. These logs are retained for approximately 30 days or longer if necessary, at ScraperNinjas' sole discretion.
27. Decline of Acceptance or Renewal of Services: ScraperNinjas retains the right, at its sole discretion, to decline acceptance of potential customers, refuse to supply additional services, or renew services with any member.
28. Terms of Service: The Terms of Service are incorporated by reference and made a part of this Appropriate Use Policy.
29. Changes to Appropriate Use Policy: Members agree that ScraperNinjas may change the terms of this policy without notice and that they shall regularly review the policy on the ScraperNinjas website for any changes. Continued use of the services following such changes constitutes consent to the changes.
30. Breach: Any breach of this Appropriate Use Policy is a breach of the Terms of Service between ScraperNinjas and the member and is subject to immediate termination without notice, at ScraperNinjas' sole discretion.

31. Severability: If any term or provision in this Appropriate Use Policy is found to be invalid by a tribunal of competent jurisdiction, the remainder of this policy shall remain in full force and effect.

By using ScraperNinjas' services, the member agrees to comply with all the terms and conditions outlined in this Appropriate Use Policy. Failure to adhere to these guidelines may result in the termination of services, without notice or refund, and the member may be subject to additional penalties as outlined in the Terms of Service. It is the responsibility of the member to review this policy regularly and ensure compliance with its provisions.
